Please read these Terms of Service and Liability Disclaimer (“Terms”) carefully before purchasing, accessing, or using any online courses, digital products, memberships, calculators, interactive utilities, retail items, raw materials, or instructional materials (collectively, the “Services”) provided by Embody Nature/Laura Davis (“Company,” “we,” “us,” or “our”) hosted on GoHighLevel, our Shopify e-commerce storefront, or any related platform.

By purchasing or accessing the Services, you (“Student,” “User,” “Buyer,” “you”) agree to be bound by these Terms. If you do not agree to these Terms, you are strictly prohibited from accessing or using the Services.

1. EDUCATIONAL PURPOSES ONLY & NO PROFESSIONAL ADVICE

The information, recipes, formulations, guidelines, safety parameters, and business strategies contained within our courses, digital content, and product descriptions are provided for general educational and informational purposes only.

* No Cosmetic or Medical Advice: We are not industrial chemists, dermatologists, or medical professionals. The formulation information provided does not substitute for professional laboratory stability testing or medical diagnosis and treatment.

* No Business or Legal Advice: Any information regarding business setups, insurance acquisition, commercial labeling regulations (including Health Canada or FDA guidelines), or financial metrics is based entirely on personal industry experience. It does not constitute formal legal, financial, accounting, or tax advice. You are strictly advised to consult with certified local professionals before launching a commercial entity.

2. ASSUMPTION OF RISK (SOAPMAKING, PHYSICAL PRODUCTION, & PRODUCT USE)

You acknowledge that handcrafted bath and body production involves inherent risks, including but not limited to the handling of hazardous chemicals (such as Sodium Hydroxide/Lye and Potassium Hydroxide), extreme heat, caustic fumes, and specialized equipment. By utilizing our Services or purchasing items from our Shopify storefront, you explicitly agree that:

* You are at least 18 years of age or possess explicit parental supervision.

* You are entirely responsible for sourcing, reading, and executing all safety data sheets (SDS) for all raw materials used.

* You will wear appropriate Personal Protective Equipment (PPE), including chemical-resistant safety goggles, gloves, and protective clothing at all times during production.

* You assume all physical and financial risks associated with creating, testing, using, gifting, or selling any products inspired by or derived from our courses or made using supplies purchased from us.

3. ABSOLUTE LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law in Canada and globally, Embody Nature and its affiliates, employees, or agents shall never be held liable for any direct, indirect, incidental, consequential, special, or punitive damages resulting from:

* Any physical injury, chemical burn, property damage, or topical skin/allergic reactions incurred while attempting to replicate our tutorials, recipes, or processes.

* Any adverse skin reactions, allergies, injury, or sensitivities resulting from the use of finished cosmetics, soaps, raw ingredients, or physical equipment purchased through our GoHighLevel platform or connected Shopify storefront.

* Any formulation failures, ruined batches, or financial losses stemming from unsellable inventory.

* Any business failure, loss of profits, regulatory fines, or legal actions brought against your business by third parties (including your own customers).

Maximum Liability Cap: In the event that a court finds the Company liable for damages despite this disclaimer, you agree that the Company’s total liability shall be strictly capped at the exact dollar amount you paid to the Company for the specific course, digital asset, or physical product purchased.

4. GLOBAL COMPLIANCE & LOCAL REGULATIONS

While this business is operated in Canada, it is accessible globally. Laws regarding cosmetic manufacturing, ingredient safety limits, manufacturing licenses, and labeling requirements (such as Health Canada, FDA, or EU cosmetics regulations) vary drastically by jurisdiction.

* You are solely responsible for ensuring that any product you make or sell complies with the local laws of the country, province, state, or municipality in which you reside or sell.

* We make no guarantees that recipes or templates provided meet the structural or legal requirements of your local regulatory bodies.

5. INTELLECTUAL PROPERTY & ACADEMIC INTEGRITY

All videos, PDFs, calculations, spreadsheets, text, product imagery, and graphics provided within the Services are the exclusive intellectual property of the Company.

* Your purchase of educational content grants you a single, non-transferable, revocable license for your own personal or internal business education.

* You are strictly prohibited from copying, screen-recording, sharing your GHL or course login credentials, reselling, or redistributing our course materials to third parties.

Violations will result in immediate termination of access without a refund and potential legal action for copyright infringement.

5b. USE OF CALCULATORS, INTERACTIVE TOOLS, AND STUDENT AUDITS

* Interactive Tools: Any formulation calculators, water/lye ratio tables, essential oil blending matrices, or safe-usage guidelines provided within the Services are tools for educational estimation and custom design practice only. They are provided on an "as-is" and "where-is" basis without warranties of mathematical, chemical, or scientific precision. It is the Student’s sole responsibility to manually cross-reference and verify all usage rates against current IFRA (International Fragrance Association) standards and local cosmetic ingredient restrictions (such as the Health Canada Cosmetic Ingredient Hotlist).

* Label Reviews & Peer Feedback: Any feedback, critiques, written remarks, or opinions provided by the Company regarding a Student’s uploaded product labels, ingredient listings, or marketing assets constitute a non-binding educational review. This feedback does not constitute legal compliance, a formal regulatory audit, or an official legal sign-off. The Company makes no representations or warranties that labels reviewed will pass inspection by Health Canada, the FDA, or any other global regulatory authority. The Student retains 100% legal liability for ensuring their own packaging, bilingual formatting requirements, and chemical naming (INCI) adhere strictly to local law.

6. GOVERNING LAW & JURISDICTION

These Terms and any disputes arising out of your use of our Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles. You explicitly agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada, to resolve any legal matters.
